4010  AUTHORITY OF THE TRUSTEES TO ESTABLISH DEPARTMENTS OF 
PUBLIC SAFETY

The statutory authority for the existence of The California State University 
(CSU) Departments of Public Safety and involved peace officers is derived 
through legislative action and is defined in the California Education and 
Penal Codes.  The jurisdiction of each CSU Department of Public Safety is 
concurrent with that of the municipal police department or county sheriff's 
department within whose jurisdiction the campus is physically located.

The Trustees are empowered to appoint one or more persons to constitute a 
police department for the headquarters and for each campus of The California 
State University.  Personnel thus appointed and duly sworn are Peace 
Officers; however, the Education Code provides that such officers shall not 
exercise their powers or authority except:

l.	At the headquarters or upon any campus of The California State 
	University, plus an area within one mile of the exterior boundaries of 
	the campus or Chancellor's Office.

2.	On any other properties owned, operated, controlled, or administered 
	by The California State University or by trustees or the State on behalf 
	of The California State University.

3.	As provided in the Penal Code.

The Penal Code provides that a member of The California State University 
Police Departments is a Peace Officer whose authority extends to any place in 
the State, but stipulates that the primary duty of any such Peace Officer shall 
be the enforcement of the law within the area specified in the Education 
Code.
