3822.02  OVERPAYMENT OF EMPLOYEES

Reference:  Government Code, Section 17051.

When overpayments occur regarding current employees, the accounting 
office will inform the employee at the earliest possible date, identifying the 
amount of overpayment.  If the person cannot repay the full amount due in 
one payment, an installment repayment schedule may be established.  Should 
the employee refuse to resolve the issue, the campus has the authority to 
withhold the ensuing paycheck and to issue a revolving fund check for the 
difference between the employee's pay and the amount owed.

When payroll overpayments concern an employee who has separated, the 
procedures described above will be followed.  In addition, the campus may 
either seek a judgment from Small Claims Court or request legal advice on 
the practicality of pursuing court action against the former employee; or, 
although diligent collection efforts should be made, if it appears that the cost 
of such efforts would be inordinate compared to the amount to be received, 
the campus may adjust its records for amounts of $25 or less.  For amounts 
greater than $25, applications for Discharge from Accountability can be 
submitted through the Chancellor's Office.
