CSU Policy on Disability Discrimination

The CSU systemwide policy statement prohibiting disability discrimination appears in Executive Order 883 and in the collective bargaining agreements. Executive Order 883 states, in pertinent part:

"[D]iscrimination on the basis of...pregnancy...disability, medical condition...is prohibited. ("Disability" and "medical condition" as used herein are consistent with the definitions provided in the Americans with Disabilities Act and the Fair Employment and Housing Act.) ...With regard to qualified individuals with a disability or medical condition, CSU shall, upon request, provide reasonable accommodation so that they may perform the essential duties of their jobs, unless doing so would impose an undue hardship on the CSU. Reasonable accommodation is to be determined by CSU following its receipt of an individual's request for accommodation and engagement in an interactive process with the individual to identify the nature and extent of the individual's restrictions and the appropriate reasonable accommodation."

Harassment based on a protected category, including disability harassment, is prohibited by Executive Order 927. Harassment is a form of discrimination. As such, the non-discrimination provisions in the collective bargaining agreements that prohibit discrimination based on a disability also serve as a policy statement prohibiting disability harassment.

Non-represented employees (e.g., Management Personnel Plan, Confidential, etc.) should reference Executive Orders 883 and 927 for the CSU policies prohibiting disability discrimination and harassment, respectively, while represented employees should reference the applicable provisions in their collective bargaining agreement, as specified below.
