Concern over Delay in Governor’s Appointment of
CSU Faculty Trustee

AS-3141-13/EX

RESOLVED: That the Academic Senate of the California State University (ASCSU) affirm
previous resolutions of concern regarding the absence of the CSU Faculty Trustee, including AS-2911-09/FGA, Concern over Delay in Governor’s Appointment of CSU Faculty Trustee; AS-2986-10/FA, A Call for Governor Brown to Appoint a Faculty Trustee; and AS-3065-12/EX (Rev), Appointment, Confirmation and Service of Trustees to the California State University (CSU); and be it further

RESOLVED: That the ASCSU affirm its unequivocal support of the two qualified CSU Faculty Trustee candidates nominated to Governor Brown in March 2013; and be it further

RESOLVED: That the ASCSU respectfully request that, per his statutory responsibility, Governor Brown appoint the CSU Faculty Trustee for the term ending June 30, 2015 as soon as possible; and be it further

RESOLVED: That the 2013-14 ASCSU Executive Committee be empowered to work with the CSU Chancellor’s Office, CSU Board of Trustees, and/or California Faculty Association to ensure the continuous presence of a faculty trustee; and be it finally

RESOLVED: That the ASCSU distribute this resolution to Governor Edmund G. Brown Jr., Lt. Governor Gavin Newsom, CSU Chancellor Timothy P. White and the remaining members of the Board of Trustees, CSU campus Senate chairs, the California Faculty Association, members of the California State Assembly Higher Education Committee, members of the California State Senate Education Committee, the California State Student Association, the editorial boards of the Los Angeles Times, San Francisco Chronicle, San Diego Union-Tribune, Sacramento Bee, San Jose Mercury-News, Fresno Bee, and the Chronicle of Higher Education, CSU Faculty Trustee nominees Professor Bernadette Cheyne and Professor Steven
Stepanek.

RATIONALE: During the period November 2012 to March 2013, the ASCSU conducted the posting, review, and interview process described in California Education Code Sections 66600-66609 and approved unanimously by the members of ASCSU on March 4, 1988 as part of AS-1773-87/EX. Adherence to the prescribed process resulted in a diverse pool of four candidates. After several rounds of secret balloting, two candidates emerged as the clear choices of the members of the ASCSU to send forward to the Governor. The process described in the above referenced California Education Code specifies that a minimum of two candidates be sent forward to the Governor. As of September 20, 2013, the CSU Faculty Trustee has yet to be appointed by Governor Brown. As noted in AS-2935-10/FA, A Call for Board of Trustee Action on Faculty Trustee Appointment:

…the absence of a faculty trustee to represent the faculty in discussions that inform BOT action, especially with respect to educational policy issues such as time to graduation, transfer, and remediation, calls into question the legitimacy of the BOT and undermines the ASCSU’s confidence in carrying out the policies of a BOT that is not fully constituted as prescribed by law…

The ASCSU search committee followed the process required in the appropriate Code, and the ASCSU conducted a fair and secret ballot. Therefore, it remains for the Governor to complete the final stage of the process and select one of the two candidates as Faculty Trustee for the 2013-2015 term.
