ARTICLE 41

DURATION AND IMPLEMENTATION

41.1

This Agreement shall be effective upon its ratification by both parties. The Agreement shall remain in full force and effect up to and including June 30, 2004.

41.2

Written notice shall be given by either party seeking to commence negotiations on a successor contract no earlier than October 1, 2003, and no later than November 30, 2003. Written notice shall be given by either party seeking to commence reopener negotiations on workload and salaries and benefits for fiscal year 2003/04 no earlier than October 1 and no later than November 30 of the preceding fiscal year.

41.3

Any term(s) of this Agreement that carries an economic cost shall not be implemented until the amount required therefore is appropriated and made available to the CSU for expenditure for such purposes. If less than the amount needed to implement this Agreement is appropriated and made available to the CSU for expenditure, the term(s) of this Agreement deemed by the CSU to carry economic cost shall automatically be subject to the meet and confer process. The terms of this provision do not apply to the implementation of salary increases for fiscal year 2002/03.
