BOARD OF TRUSTEES RESOLUTION(S)
Subject: Auxiliary Organization Policy, Amendment to Title 5,
Section 42403(c)(1) California Code of Regulations--Political Activities
Reference: RGPA 01-88-02
RESOLVED, By the Board of Trustees of the California State University, acting
under the authority of Sections 89030 and 89900 of the Education Code and to
implement, interpret, and make specific Sections 89302 and 89900 of the
Education Code and, pursuant to the Administrative Procedure Act, that this
Board hereby amends, its regulation in Article 1 of Subchapter 6 of Chapter 1,
Part V of Title 5, California Code of Regulations, as follows:
1. Subsection (c) of Section 42403 is amended to read:
(c) Funds of an auxiliary organization shall be used for purposes consistent
with Board of Trustees and campus policy, shall not be used:
(1) To support or oppose any candidate for public office, whether partisan
or not, or to support or oppose any issue before the voters of this state or any
subdivision thereof or any city, municipality, or local governmental entity of
any kind except as may be permitted by Section 89300 of the Education Code.
The Prohibition of this subdivision shall not apply to:
(A) expressions published in the student press;
(B) support of a position taken by the Board of Trustees on an issue which
the Board determines will significantly affect The California State University
or any campus thereof.
2. The California State University has determined that the adoption of the
proposed amendments will not impose a cost or savings on any State agency;
will not impose a cost or savings on any local agency or school district that
is required to be reimbursed under Section 17561 of the Government Code; will
not result in any nondiscretionary cost or savings to local agencies; will not
result in any cost or savings in federal funding to the State; will not impose a
mandate on local agencies or school districts; will not have any potential cost
impact on private persons or businesses; will not affect housing costs; and will
not have any significant economic impact on small businesses; and be it further
RESOLVED, That this Board delegates to the Chancellor of the California State
University authority to further adopt, amend, or repeal this regulation
pursuant to the Administrative Procedure Act if the further adoption, amendment,
or repeal is required by the Office of Administrative Law and is nonsubstantial
or soley grammatical in nature, or sufficiently related to the original text that
the public was adequately placed on notice that the change could result from
the originally proposed regulatory action (Government Code Section 11346.8(c).
