Eligibility —
CSU Family Medical Leave (FML)

All full-time and part-time employees (excluding student employees) employed for at least one academic year or 12 months (does not have to be continuous) preceding the leave are eligible. Employment includes appointments at any CSU campus, or any other California state agency. Newer FMLA regulations permit an employer to exclude employment preceding a break in service of seven (7) years. However, through policy, the CSU will continue to apply all prior service towards the CSU FML entitlement. Additionally, in determining the initial year of eligibility, an employee’s service in National Guard or Reserve military duty is
applicable.

Student employees are eligible for FML, if employed for at least one year (does not have to be continuous) and have worked at least 1,250 hours in the 12 months preceding the leave. Student employees, who are not otherwise eligible for benefits, are entitled to the unpaid leave and reinstatement rights only.
